Abstract

This article outlines the main theoretical and legislative approaches to defining the concept of «loss of trust» in the context of establishing grounds for dismissal of a civil servant in the event of direct corruption violations or failure to take measures to prevent such violations (in the event of a conflict of interest). Trust is proposed to be considered from two perspectives: 1) as a factor of legitimacy – the public trust in the state authorities (and, consequently, in the institution of civil service itself and in the civil servants who directly exercise authority on behalf of publicly elected government bodies); 2) as a condition for the conscientious and impartial performance of official duties by a civil servant, with zero tolerance for corruption, based solely on legal requirements – the trust of the employer's representative in the civil servant. Based on this, trust is a prerequisite for the functioning of the civil service institution in accordance with general constitutional principles (democracy, the priority of individual rights and freedoms) and the requirements of anti-corruption legislation in particular official relationships. The authors distinguish between the recognition of «loss of trust» as grounds for termination of employment and official relationships, and the early termination of the powers of a highest-ranking official of a territorial entity of the Russian Federation. Unlike labor and constitutional relationships, loss of trust in the public service (including the federal civil service) is associated exclusively with combating corruption and ensuring the principles of publicity and professionalism of the civil servant. The article specifically emphasizes the need to comply with the general requirements of official legislation when deciding on dismissal due to loss of trust – specifically, the employee's right to provide explanations at all stages of disciplinary proceedings and consideration of the civil servant's previous performance of their official duties.
