The Superstructure of the Defendant's Final Statement Discourse: Cognitive Perspective and Illocutionary Code

Abstract
The article deals with the discourse of the defendant's last word, its cognitive-rhetorical organization, structural and genre specificity. Using a continuous sample of video content, linguistic observation, discourse analysis, and formalization of research findings, we identified and analyzed the media fragment of the superstructure by defendant's final statement discourse in terms of its organization, modeling of the illocutionary profile, and identification of the cognitive mechanisms that ensure the success of the speechact participant's initial communicative intention. The study established that the defendant's final statement represents a hierarchically organized system of categories formed on the basis of and around the opposition «admission of guilt vs. denial of guilt vs. partial admission of guilt». Their varying regularity and optionality allowed us to identify two heterogeneous subtypes of the defendant's final statement discourse –«Admission of Guilt» and «Denial of Guilt». It was revealed that the illocutionary profile of the object of this scientific study is formed based on the initial communicative intention of the speaker (self-defense) in its two versions—justification and mitigation of punishment—through bidirectional influence—persuasion and the creation of an impression of the defendant's personality through the activation of a number of cognitive mechanisms (specification, amplification, spin-doctoring, causation, and others). The discursive rhetorical graphs of the defendant's final statement convincingly demonstrate the unequal communicative significance of the discursive relations between discourse entities within the superstructure under study, and also allow us to identify and substantiate the frequency of intentional rhetorical relations compared to substantive ones, the nature of the speaker's derived communicative intentions, and their hierarchy within the overall structure of global discourse.
