The History of Distance Working Development in Russia: from the First Legislative Initiatives to Modern Standards
УДК 343.01, ББК 67.408
Abstract
The relevance of the study is due to the high pace of development of scientific and technological progress, which in turn leads to the emergence of new, atypical forms of employment. The world of work has undergone significant changes, one of which has been the active spread of distance working. The development of information technology, growing globalization and changes in the organization of work have led to the formation of a new type of employment that does not require the constant presence of the employee on the employer’s premisis. In Russia, the issue of distance working first became the subject of discussion at the legislative level in the early 2000s, when the emergence of new forms of employment became an urgent task for legal regulation. The first legislative initiatives were aimed at establishing the basic rights and obligations of participants in the distance working process, but they could not take into account all the features of such work. Despite the fact that Ch. 49.1 was introduced into the Labor Code of the Russian Federation back in 2013, special interest in remote work arose against the backdrop of the COVID-19 pandemic, when remote employment became a factual constraint for many employers. This has led to accelerated reform of the regulatory framework relating to distance working, with the aim of adapting legislation to changing working conditions. The introduction of new rules and regulations made it possible to more accurately regulate labor relations in conditions of distance employment, taking into account the peculiarities of work processes. The conducted research allowed us to conclude that it is necessary to further improve labor legislation in the field of legal regulation of distance working.
